MoistureLoc Contact Lens Solution ( Lead To Fusarium Keratitis Infection ) Solution Maker Sues Insurance Company


Rochester-based eye care company Bausch & Lomb has filed a class action lawsuit against Boston based Lexington Insurance Co. in U.S. District Court for the Western District of New York. B&L has charged that Lexington, a subsidiary of insurance giant American International Group (AIG) is trying improperly to get out of covering the cost of defending claims being brought against B&L. The product liability lawsuits, all of them revolve around the company's discontinued MoistureLoc contact lens solution. The suit further centers around whether a defect in it was responsible for an outbreak of a rare fungal eye infection in numerous consumers. Nearly 1,500 people have filed claims against B&L in relation with MoistureLoc-related injuries "and more continue to be brought."

It can be recalled that it is not the first legal battle of B&L against insurance companies. In December 2007, B&L has sued Lexington and three other companies namely ACE American Insurance Co., Illinois Union Insurance Co. and Steadfast Insurance Co. The charges were roughly the same against all these three companies. However, Lexington is the subject of the new B&L lawsuits. Bausch is asking for a court order forcing Lexington to defend B&L against MoistureLoc claims.

The B&L spokesman Michael McDougall has made no comment on the probable settlement with these three companies.
